On January 16, 2020, China and the United States signed the Economic and Trade Agreement between the Government of the People's Republic of China and the Government of the United States (hereinafter referred to as the "Agreement") in Washington. The Article 2(8) of Appendix 2 of Chapter 3 of the Agreement stipulates that within 60 working days from the date when the Agreement takes effect, the approval of America edible milk permeate powder shall be completed and the import of America milk permeate powder shall be allowed; If China formulates new standards for milk permeate powder, it should notify the WTO of the draft standards, etc.

On March 6, 2020, the National Food Safety Risk Assessment Center entrusted by the National Health Commission to publicly solicit opinions on "Dairy Permeate Powder" that is planned to be imported in accordance with food management that have no national food safety standards complying with the requirements of the Food Safety Law and the Notice of the General Office of the National Health and Family Planning Commission on Regulating Imports and Examination of National Food Safety Standards.

On May 15, 2020, the National Health Commission formally issued the Applicable Standards for Dairy Permeate Powder (Provisional), marking it as the second imported food without national standard approved by China and a food ingredient used officially.


Definition

According to the announcement, "dairy permeate powder" refers to the products whose main components are lactose and milk minerals after evaporation and drying by the removal of whey protein in whey or cow milk protein in whey or cow milk through membrane filtration or other processing techniques (such as ion exchange).

Dairy permeate powder is currently used as an ingredient for food processing in China.However, in many countries and regions, such as the European Union, the United States, Australia, South Korea and Japan, it is also widely used in a variety of food and beverage products. In the United States, it can be used as a direct substitute for other dairy solids, including baked products, pizza crust dough and confectionery products. It can also be used as a substitute for sucrose or corn syrup and to reduce the salt content of the formula products and fermentation. It can also be used to  provide lactose and minerals for young animals.

Comparison of Domestic Standards

The formulation of Applicable Standards for Dairy permeate powder (Provisional) mainly refers to relevant standards, including GB 25595-2018 National Food Safety Standard Lactose, GB 19644-2010 National Food Safety Standard Milk Powder, GB 11674-2010 National Food Safety Standard Whey Powder and Whey Protein Powder, Milk Minerals (novel food ingredient announcement), GB 2762-2017 National Food Safety Standard Maximum Levels of Contaminants in Foods and GB 2761-2017 National Food Safety Standard Maximum Levels of Mycotoxins in Foods and other relevant national food safety standards.

For the analysis of various indicators in the standards, Antion compared the physical and chemical indicators and microorganisms.

(1) Comparison of the Physical and Chemical Indicators

The physical and chemical indicators mainly include lactose, nitrogen, fat, moisture and ash. The contents in the Applicable Standards for Dairy Permeate Powder (Provisional) are generally consistent with the ADPI standard of the US and CDC standard. The contents of nitrogen and ash are slightly different.

As can be seen from Table 1, dairy permeate powder is a kind of lactose powder with its purity lower than lactose and mineral content much lower than that of milk mineral salt. The compositions are relatively unstable, and it is less possible to be used for infant formula. 

(2) Comparison of Microorganisms Limits

The requirements for microorganisms’ limits of the Applicable Standards for Dairy Permeate Powder (Provisional) are shown in Table 2 by contrasting with GB 25595-2018 National Food Safety Standard Lactose, GB 11674-2010 National Food Safety Standard Whey Powder and Whey Protein Powder and GB 19644-2010 National Food Safety Standard Milk Powder.
