Q: If the shareholders of a foreign company permit the Chinese company in which they have shares to use its trademark and sign a trademark license agreement, do they need to go to the local trademark office of the Chinese company to file? What is the filing process?
A: According to Article 3 and Article 43 of the Trademark Law, a trademark approved for registration by the Trademark Office is a registered trademark. If the trademark registrant permits others to use its registered trademark, the registrant shall file the trademark use license with the Trademark Office, and the Trademark Office shall announce it.
